Starburst is committed to helping protect the privacy of individuals (“Visitors”) who visit Starburst’s Sites and individuals and companies (“Customers”) that register to use or purchase our software or services (collectively “Products”).

We respect your privacy and we are committed to protecting your personal data in line with the General Data Protection Regulation – Regulation (EU) 2016/679 (GDPR) and the UK Data Protection Act 2018 (“Data Protection Laws”). This Policy aims to give you information as to how we will look after your personal data when you interact with us, including visiting our Sites or using our Products. What Is Personal Data And Who Is Responsible For Looking After Your Personal Data?

Personal data means any information about an individual that can identify a person. Starburst is the controller of your personal data in accordance with applicable Data Protection Laws, and depending on your interactions with us, may include your full name, contact details (such as email, telephone contact number, work address), company name, job title, job function, business affiliations, details of an enquiry you might submit to us, and technical details we obtain in connection with your use of Starburst’s Sites.

How Long Will We Keep Your Personal Data For?

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

Collection and Use of Information for Visitors to Starburst’s Sites

Starburst may collect certain information from visitors to the Sites as described below. Starburst uses information it collects for various purposes, which may include registration of our customers, authentication, fulfillment of your requests for products and services, to collect payment, and to communicate with you regarding our products and services.

  • Registration Information: Starburst collects personal data you knowingly choose to submit to us at any time, including through our ‘Contact Us’ form, such as your name, email address, telephone numbers, emails sent and replies, chat usage, and purchase history, for the purpose of authenticating users, sending appropriate notifications to users, managing each user’s account and facilitating our compliance with applicable regulatory requirements. We use this personal data to takes steps to enter into an agreement with you or for our legitimate interests.
  • Automated Technologies or interactions: As you interact with our Sites, we may automatically collect technical data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, server logs and other similar technologies. Every time you visit an Internet location page on the Internet, your Web browser sends information to the Sites you are visiting. Starburst servers automatically collect and store this information. We may associate this information with your personal data to resolve technical issues and promote security. We may use Web beacons alone or in conjunction with cookies to compile information about customers’ and visitors’ usage of our Sites and interaction with our emails. Collection and Use of Information for Customers of Starburst

When you use our Products, we may collect certain details in respect of you or other representatives of your business, including full name, contact address (business and email), telephone number and contact history, for the purpose of managing our relationship with you. Information that Starburst may collect also includes: API calls, web traffic, page views, source and target IP addresses, amount of data moved, bandwidth usage, storage usage. Starburst may gather additional information, and you can always check this Policy, as may be updated from time to time, in order to determine what information is currently gathered by Starburst.

We will process Customer personal data to comply with the contractual terms we have entered into with you or are about to enter into with you, to comply with our legal and regulatory obligations and for our legitimate interests, for the purposes as follows:

  • We may collect and temporarily cache and store information relating to end users as necessary to provide the Products. We will store any such information only to the extent and for the time necessary to provide the Products.
  • From time to time, we may partner with other companies to jointly offer Products. If you purchase or specifically express interest in a jointly-offered product or service, we may share personal data collected in connection with your purchase or expression of interest with our joint promotion partner(s). However, we do not control our business partners’ use of personal data, and their use of the information will be in accordance with their own privacy policies. If you do not wish for your information to be shared in this manner, do not purchase or specifically express interest in a jointly offered product or service. If you do not wish Starburst to gather the information through the functionality of the Products, you must not install and/or otherwise use the Products.
  • We will process your personal data to notify you about changes to our Products.
  • We may use your personal data to comply with our legal and regulatory obligations and requests, including reporting to and/or being audited or investigated by national and international regulatory bodies and to comply with court orders and to exercise and/or defend our legal rights.
  • When we rely on our legitimate interests to process your personal data, we do so to maintain business relationships and communicate with you as a business contact and to generally manage our business operations.

Registration & Marketing

At your election (opt-in), you may desire to register for a web event sponsored by Starburst or subscribe or gain access to various information resources concerning Starburst’s products, services, user groups and business. If you do so, our registration process may require you to provide your first and last names, company name, address, telephone number, email address and certain additional information (such as, for example, your preferred contact method to send to you information about similar products or markets that may be of interest to you), which is referred to as “Registration Data.” We process your Registration Data for our legitimate interests to register you for the event you have requested and to further communicate with you. If we are required to do so according to Data Protection Laws, we will rely on your consent to process your Registration Data.

Starburst uses Registration Data to contact you when necessary, to respond to your inquiries for additional information, to verify your registration for closed events, to provide additional information according to your preferences and for Starburst’s other business purposes. Sometimes Registration Data is used to send you information about Starburst and its Products and business partners. At your election at any time (opt-out), you may choose to stop receiving future communications from Starburst (see below). Public Forums

We may provide bulletin boards, blogs, or chat rooms on our Sites. Any personal data you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. We are not responsible for the personal data you choose to submit in these forums. We will access this personal data in accordance with our legitimate interests for the purposes of monitoring chat rooms to ensure such use is in line with the Site’s terms of use.

Restrictions on Disclosure of Your Information to Third Parties

Starburst will not disclose your personal data or information regarding your use of our Sites or Products to any third party without your prior consent except to affiliates and service providers (such as our providers of IT, banking, legal, audit or other services, which assist Starburst with its general business) solely for the purpose of providing the Products to you or in connection with the transfer of our business or assets to which the information relates (collectively “Third Parties”). We will require all Third Parties to abide by confidentiality obligations in order to protect your information. In addition, we require that Third Parties provide robust protection of your information no less protective than as set out in this Policy. Moreover, we may disclose your information as lawfully requested by governmental, judicial or public authorities, including to meet national security or law enforcement requirements, to comply with applicable laws and regulations, and pursuant to legal and equitable actions concerning the Products, this Policy or the Terms of Use. If we are involved in a merger, acquisition or asset sale, such information may be shared with the acquiring entity or successor-in-interest, but we will continue to ensure the confidentiality of any personal data pursuant to the terms of this Policy.

International Transfers

If you are based in the European Economic Area (“EEA”) or the United Kingdom, please note that as we have offices and facilities in the United States, we may transfer your personal data outside the EEA or the United Kingdom to the United States. We may also utilize service providers that are based outside of the EEA or the United Kingdom. This means that your personal data may be transferred outside of the EEA or the United Kingdom.

Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

Your Choices – Your Right To Opt Out, Access, Change or Delete Your Personal data

You may have the opportunity to opt-out of any disclosures by Starburst of your personal data in accordance with this Policy. Our opt-out procedure is simple and straightforward. If we are required to do so, we will promptly honor and confirm your request by email or mail. You also have the right to know what personal data about you is included in our databases and to ensure that such information is accurate and relevant for the purposes for which Starburst collected it.

You may access, edit or delete your personal data by contacting Starburst by mail or email as per the For More Information section below. In making modifications to your personal data in Starburst’s possession, you must provide only truthful, complete, and accurate information. Starburst will endeavor to respond in a timely manner to all reasonable written or email requests to view, modify, or delete your personal data, but in no event will our initial response take longer than thirty (30) days. We reserve the right to verify the identity of anyone requesting access to personal data pursuant to this Policy. You have the right to:

  • Request access to your personal data (commonly known as a “data subject access request”). You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

Acceptance of Privacy Policy

Children’s Privacy
